Mr. McGuire is an attorney specializing in Labor law and ERISA. Mr. McGuire has been practicing law since 2006. He graduated from the University of Wisconsin and received his Juris Doctorate from The John Marshall Law School, now known as the University of Illinois Chicago School of Law, where he concentrated his studies in labor law and employee benefits.
He has represented numerous Taft-Hartley Plans in ERISA matters, employer delinquencies, subrogation, and plan consulting. He has dealt with the DOL in a number of capacities over the years, including plan audits, regulatory inquiries, prohibited transactions, and correction programs. He has represented clients before the National Labor Relations Board and the Department of Labor.
He has extensive experience in pursuing delinquent employers through alter-ego and successor in interest claims, as well as lien and bond claims. Throughout his career, he has successfully collected millions of dollars on behalf of the plans he represents. He has drafted and updated multiple trust agreements, welfare plans, pension plans, plan amendments, and SMM's to keep his clients protected and up to date on all regulatory matters affecting the plans.
He has experience with unfair labor practice charges, dealing with the National Labor Relations Board, and litigation arising under the Labor Management Relations Act and the Labor Management Reporting and Disclosure Act. He has spoken on subrogation rights of welfare plans and recovered large amounts on behalf of those plans through subrogation.
Over the course of his practice, Mr. McGuire has also litigated numerous breach of contract claims, defamation matters, and employment-related matters, including discrimination claims, employment practices and policies claims, and claims arising under the Illinois Human Rights Act and EEOC issues.
Mr. McGuire is licensed to practice in both the State of Illinois and the State of Wisconsin. He is a member of the Illinois State Bar Association, Wisconsin State Bar Association, International Foundation of Employee Benefits, and the Union Labor Lawyer Alliance.
